Plan sponsors have fiduciary responsibility to ensure that their company retirement plans are designed and administered appropriately. From maintaining plan documents, to selecting service providers to selecting and monitoring plan investments, there are a significant number of legislative and regulatory duties that the sponsor has to keep in mind.

To help plan sponsors perform all of these duties, PLANSPONSOR has created a virtual mini conference to address key topics in four sessions on November 10. Plan sponsors can learn:

    The Employee Retirement Income Security Act (ERISA) has been the “guidebook” for retirement plan fiduciaries since 1974, and subsequent legislation has amended or added to its rules. Listen as experts discuss requirements for maintaining plan documents and operating a plan according to its terms. They also discuss what should be reported—and by what means—to participants and regulators, as well as how sponsors can ensure they adhere to the fiduciary duties of prudence and loyalty.

    Though plan sponsors have ultimate responsibility for the compliance of their plan, the recordkeeper and other service providers can decrease the burden. However, selecting a provider is itself the plan sponsor’s fiduciary responsibility. In this session, sources will discuss the types of outsourcing available to plan sponsors—3(16) administrators, 3(21) investment advisers, 3(38) investment managers and pooled employer plans (PEPs)—as well as what can be expected from each.

    Chambers is a nationally recognized expert on 401(k) fees. He has met with officials from the SEC, the GAO and the DOL to discuss regulations relating to 401(k) fee disclosure. He testified before the House Committee on Education and Labor on this issue.
    Chambers graduated from the University of California, Berkeley with departmental and college honors. He is a member and past president of the San Francisco Chapter of the Western Pension & Benefits Council and a member of the National Association of Plan Advisors. Chambers holds the Certified Plan Financial Advisor designation.

    Allison Itami advises employers and service providers on employee benefit programs, including health and retirement plans, with a focus in federal laws such as ERISA and the Internal Revenue Code, and the ways in which state laws affect benefit plans. Allison frequently works with state and municipal governmental units sponsoring and administering benefit plans and programs.

    Allison works closely with service providers in the IRA and employer plan industry. These service providers include multi-national financial institutions, national and regional broker-dealers, banks, record-keepers, and insurance companies. Allison assists these financial institutions to comply with existing Department of Labor regulations and guidance.

    Additionally, she provides advocacy regarding proposed regulations, advisory opinions, and individual prohibited transaction exemptions ranging from fiduciary investment advice to captive welfare benefit insurance arrangements to stock rights issued to plans.

    She has worked with employers to draft, maintain, or terminate tax qualified retirement savings plans. From drafting policies to assisting with internal or Department of Labor audits, Allison has assisted plan fiduciaries with all manner of compliance processes. She assists plan fiduciaries in performing legal due diligence on selecting a service provider or investing in an alternative investment option. Her practice also includes providing legal counsel on investment items including prudent process and considerations for investing and divesting.

    Allison’s practice includes a focus data privacy and cybersecurity issues. In addition to assisting service providers, she advises plan personnel regarding the use of plan data, data security provisions in service contracts, and post-incident actions. Allison is a frequent speaker at conferences on the topic of cybersecurity as it relates to benefit plans.
