Alliance Capital Slapped With Another Enron Related Suit

December 20, 2002 (PLANSPONSOR.com) - In form 8-K filed with the Securities and Exchange Commission on December 13, Alliance Capital Management Holding LP revealed it is facing a lawsuit for alleged violations under the Securities Act of 1933, according to a Dow Jones report.

Alliance, in the filing, said the alleged violations stem from investments the company made in various Enron securities.   The lawsuit claims the registration statement and prospectuses for the Alliance Capital Growth Fund contained untrue statements and omitted material facts in the strategic objective and investment strategies of the Fund.

Filed in the Southern District of New York, the suit names Alliance Capital, Alliance Premier Growth Fund and other firm employees as defendants and is seeking an unspecified amount of damages.  

Alliance said the allegations are without merit and will defend itself against the claims.  

The lawsuit was filed byPatrick Goggins et al, according to the filing, which did not disclose any relationship between the plaintiff and Alliance.Similar suits were filed against the company in  September  and  June .
