EEOC Prevails in Severance Age Discrimination Claim

June 14, 2001 (PLANSPONSOR.com) - The US District Court of Massachusetts granted a motion for summary judgment to the US Equal Employment Opportunity Commission (EEOC) against Bull HN Information Systems.

The suit, filed jointly with the Office of the Attorney General charged the company with violating the Age Discrimination in Employment Act of 1967 (ADEA).

In the suit, the plaintiffs allege that the company’s severance plan adversely affected older employees by requiring them to sign waivers of their right to file charges and cooperate with public agencies as a condition of obtaining severance benefits.

Further, the suit alleges that Bull HN’s severance plan failed to meet the requirements of the ADEA by not allowing employees sufficient time to consider the terms of the agreement, and/or not providing employees with additional compensation.
