T-Mobile Hit with OT Payments Suit

July 17, 2009 (PLANSPONSOR.com) - Current and former workers at wireless provider T-Mobile have filed suit against the company over allegations they were not properly paid for all hours worked.

A news release from New York law firm Pelton & Associates PC said the suit seeks to be declared a class action on behalf of those working for the company as retail sales associates and supervisors, from July 10, 2006 to the present.

The suit alleges T-Mobile violated the federal Fair Labor Standards Act as well as state laws governing overtime payments in California and New York.

According to the news release, T-Mobile issued employees “smart devices” and required them to review and respond to numerous T-Mobile-related e-mails and text messages regardless of whether they were logged into the company’s computerized timekeeping system.

The suit alleged that the employees were required to take and place T-Mobile-related telephone calls, participate on T-Mobile conference calls and to work “off the clock” during scheduled lunch breaks.
