DoL Releases PPA-Generated Rule on QDROs

March 6, 2007 ( - Federal rulemaking generated by the Pension Protection Act (PPA) continued Tuesday with the U.S. Department of Labor's (DoL) unveiling of an interim final rule about qualified domestic relations order (QDRO) requirements.

The PPA requires DoL issue regulations by August 2007 clarifying that a domestic relations order otherwise meeting the Employee Retirement Income Security Act’s (ERISA) requirements would not fail to be treated as a QDRO solely because of when it is issued or because it is issued after, or revises, another domestic relations order, according to a DoL news release.

The rule includes examples to address various circumstances involving the timing of a domestic relations order.
