Employee Abused Wellness Program for Incentives
August 18, 2010 (PLANSPONSOR.com) - An employee of the University of California San Francisco Medical Center obtained and used the personal information of other UC employees to create accounts on a health management Web site, complete online health surveys, and receive incentives.

An announcement from United States Attorney Joseph P. Russoniello said StayWell Health Management, Inc. conducted the online health assessments for employees, and rewarded them for completing the survey with a $100 online voucher. Cam Giang said he completed approximately 382 online StayWell health surveys using the personal information of other UC employees without their knowledge.
After an investigation by the FBI, Giang was charged with one count of wire fraud, in violation of 18 U.S.C. § 1343; and one count of use of a social security number in violation of 42 U.S.C. § 408( a )( 8 ). He pled guilty to both counts.
The announcement said the maximum statutory penalty for the wire fraud offense is 20 years’ imprisonment and a fine of $250,000, plus restitution if appropriate. The maximum statutory penalty for the use of a social security in violation of the laws of the United is five years’ imprisonment and a fine of $250,000, plus restitution if appropriate.
