Infertility Patient Wins in Bias Settlement

March 22, 2002 (PLANSPONSOR.com) - A woman who claimed she was fired after her employer refused to give her three days off to complete infertility treatments, has won a $135,000 settlement.

The lawsuit alleged that the plaintiff was a disability bias victim, according to HR News Online.  The Equal Employment Opportunity Commission (EEOC)’s suit on behalf of the employee charged Huntington Hills with violating Title I of the Americans with Disabilities Act (ADA).

Her employer, Huntington Hills Center for Health and Rehabilitation of Melville, New York, agreed to a settlement brokered by the EEOC for back pay and compensatory damages.

In addition to the damage payment, the company also agreed to train its management and staff about the ADA’s requirements and to correct any potentially discriminatory aspects to its employee policies.
