Judge Sets Florida HCR Challenge Hearing Date

April 1, 2011 (PLANSPONSOR.com) – Florida Attorney General Pam Bondi announced that the 11th U.S. Circuit Court of Appeals has scheduled oral argument on June 8 for the health care reform challenge filed in that state.

The AG had filed a motion for an expedited schedule and a motion for an en banc, or full court, hearing by the 11th Circuit, but that motion for an en banc hearing was denied. Bondi claims this latest decision will allow the case to move forward quickly and hopefully will result in the case being heard by the U.S. Supreme Court in the fall.  

U.S. District Judge Roger Vinson of the U.S. District Court for the Northern District of Florida has favored arguments by 26 states that requiring Americans to buy health insurance starting in 2014 or pay a penalty is unconstitutional (see Vinson Delays HCR Challenge Ruling until Appeals Over).
