Medical Supply Consultant President Pleads Guilty to Plan Theft

January 12, 2011 (PLANSPONSOR.com) - James K. Edler, Jr. has been sentenced to 40 months in prison for charges arising from three separate indictments.

Edler was President of  McFaul & Lyons Group, LLC, medical supply management consultants, located in Horsham, Pennsylvania, when, in 2004 and 2005, he stole $105,555 from an employee pension benefit plan, according to a news release from the office of the U.S. Attorney in Pennsylvania.   

Edler was also charged, in separate indictments, with bank fraud and wire fraud.  In an attempt to obtain approximately $20,000 that was levied by the IRS, he faxed a fraudulent Form 668-D “Release of Levy” that he altered from Pennsylvania to the Roy L. Schneider Hospital located in St. Thomas, Virgin Islands, in October of 2006, the news release said.     

Edler pleaded guilty to all charges. In addition to the prison term, he was ordered to pay restitution to the employees in the amount of $105,555 and to M&T Bank in the amount of $217,791.
