Obama Administration Files Appeal of Health Care Ruling

March 9, 2011 (PLANSPONSOR.com) - The Obama administration has filed an appeal of a U.S. judge's ruling in Florida that struck down the health care overhaul law as unconstitutional, Reuters reports.

The case will go to the 11th U.S. Circuit Court of Appeals. 

U.S. District Judge Roger Vinson of the U.S. District Court for the Northern District of Florida in January backed arguments by 26 states that the law’s requirement that Americans buy health insurance starting in 2014 or pay a penalty is unconstitutional. Last week, he agreed to put his decision on hold pending appeal and ordered the Obama administration to file its appeal by Thursday and to seek a fast-track review (see Vinson Delays HCR Challenge Ruling until Appeals Over).
