CA Recognizes Same-sex Marriages from Other States

October 13, 2009 (PLANSPONSOR.com) - California Governor Arnold Schwarzenegger has signed into law a bill that recognizes same-sex marriages entered into in other states, Business Insurance reports.

California itself has a mixed system of marriage after the California Supreme Court in May upheld Proposition 8, the voter-approved law restoring a ban on same-sex marriages, but left intact the more than 18,000 marriages of couples who wed last year when the high court originally approved the unions (see CA High Court Ruling Creates Mixed System for Same-sex Couples ).

According to the news report, Schwarzenegger said in a statement, “This measure honors the will of the people in enacting Proposition 8 while providing important protections to those unions legally entered into in other states.”

California follows New York, where last year the Appellate Division of State Supreme Court decided that same-sex marriages validly performed out-of-state must be legally recognized, just as the law recognizes those of heterosexual couples married elsewhere (see NY Court Rules to Recognize Same-Sex Marriages from Out-of-state ).
