Federal Judge OKs California Immigration Agent's Discrimination Suit

June 5, 2006 (PLANSPONSOR.com) - A US Immigration & Customs Enforcement worker was given the go ahead Friday by a federal judge to proceed with her workplace discrimination and retaliation lawsuit that claims she was passed over for several promotions based on her age, gender and ethnicity.

According to The Brownsville Herald, Maria De Guzman, 53, has more than two decades of federal government service.

She filed her suit in December, claming that the younger male officers that she trained were promoted ahead of her, the newspaper reported. Guzman also alleges she served on as an investigator on an FBI-led team but was passed up for a supervisory job by a younger, Anglo female in October 2003.

The newspaper reported that Guzman’s suit alleges that a work-related injury and prior complaints filed with the Equal Employment Opportunity Commission (EEOC) and a federal employees union hindered her promotion. However, EEOC investigations cleared US Immigration & Customs Enforcement officials of any wrongdoing.

Guzman has asked for a federal jury to hear the case. US District Court Judge Andrew Hanen set a July 2007 trial date.
