Worker's Bad Attitude Overrides His Disability

December 6, 2005 (PLANSPONSOR.com) - The US Supreme Court refused to review a case concerning a blind worker who was fired for a bad attitude, poor work ethic, and being careless.

By its refusal, the high court let stand a US 7 th Circuit Court of Appeals ruling in Hammel v. Eau Galle Cheese Factory that the employer did not violate the Americans with Disabilities Act (ADA) when it fired the employee, Thompson.com reports.

The employee wanted the Supreme Court to find that the employer should have been required to participate in the interactive process to find a reasonable accommodation for his disability, according to Thompson.com.   The appeals court ruled that there was no accommodation that would overcome the employee’s reckless work habits, arrogance and insubordination, so the employer’s failure to engage in the interactive process did not need to be addressed.
